II. EXCLUSION OF LIABILITY
PAVAPARK is not responsible for any damages of any kind that may arise from the temporary unavailability or lack of continuity of the system used to participate in the Contest, or from the system not meeting the expectations that the participant has placed on it, and in particular, but not exclusively, from failures in accessing the page and sending responses over the Internet.
III. EXCLUSION OF PARTICIPANTS
PAVAPARK may, at its sole discretion and at any time, exclude any participant from the contest if, for any reason, their participation is inappropriate or undesirable, or if the participant violates any of the rules set forth in this document.
IV. RESERVATION OF RIGHTS OF THE ORGANIZATION
PAVAPARK reserves the right to make changes to the terms of this Contest or add subsequent appendices regarding its rules and prizes, provided that such changes are justified or do not adversely affect participants and that they are duly notified to the participants through the PAVAPARK website. If it becomes necessary to postpone or cancel the contest, this will be stated in these rules. Therefore, we invite you to review them after participating.
V. DATA PROTECTION
For the purposes of the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, and its implementing regulations, the organization informs participants of the existence of an automated personal data file owned by it and duly registered with the Spanish Data Protection Agency, for the purpose of managing the contest and awarding the two prizes.
Participants may exercise their rights of access, rectification, cancellation, and objection to the processing of their personal data by sending a written communication to the PAVAPARK Legal Department at Calle Tres Forques No. 149, Valencia 46014, or by sending an email to the following address: info@pavapark.com, attaching a copy of their National Identity Document (DNI) on both sides.
The contest rules require that data be provided truthfully and completely, and that it be kept up-to-date thanks to the cooperation of participants. If personal data is found to be inaccurate, incomplete, or outdated, the organizers will be released, in specific cases, from the successful awarding of prizes and from any related consequences, ultimately leading to the non-declaration of the contest’s beneficiaries.
VI. NULLITY OF CLAUSES
In the event that PAVAPARK, in its power to interpret and modify the rules of this Contest, were to declare any clause of these Rules to be totally or partially null or ineffective, it would only affect that provision or part of it, with the rest of the Rules remaining in effect.
VII. JURISDICTION AND COURTS
These Rules shall be construed and governed by Spanish law. For any disputes arising from the Contest, both the participant and PAVAPARK expressly waive any other jurisdiction to which they may be entitled, and submit to the exclusive jurisdiction and venue of the Courts and Tribunals of Valencia City.
