Introduction
This contractual document will govern the General Conditions for contracting services (hereinafter, “Conditions”) through the website pavapark.com, owned by PAVAPARK MOVILIDAD SL, hereinafter, PROVIDER, whose contact details also appear in the Legal Notice of this website.
These Conditions may be modified at any time. It is the responsibility of the USER to read them periodically, since those that are in force at the time of placing the orders will be applicable.
The contracts will not be subject to any formality with the exception of the cases expressly indicated in the Civil Code, that of Commerce, the Consolidated text of the General Law of the Defense of Consumers and Users, the Law of Information Society and Electronic Commerce. and the Retail Trade Law or other special laws.
The acceptance of the conditions made during the contracting process will entail the USER’s agreement with the content of this document:
- You’ve read, you understand and you’re agree with this text.
- You are a person with sufficient capacity to contract.
- Assume all the obligations set forth herein.
These conditions will have an indefinite validity period and will be applicable to all contracts made at the time of their validity through the PROVIDER’s website.
The PROVIDER hereby states that the sale of its products or services is conducted responsibly and in accordance with current Spanish law, and reserves the right to unilaterally modify the terms and conditions, without this affecting any goods or promotions purchased prior to the modification.
Identity of the contracting parties
On the one hand, the PROVIDER of the services contracted by the USER is PAVAPARK MOVILIDAD S.L., with its registered office at Calle Tres Forques, 149 – 46014 Valencia (Valencia), Tax ID No. B98552847, and with a customer service/USER phone number of +34 961 280 635.
And on the other, the USER, registered on the website by means of a username and password, over which he has full responsibility for use and custody, and is responsible for the veracity of the personal data provided to the PROVIDER.
Object of the contract
The purpose of this contract is to govern the contractual relationship established between the SERVICE PROVIDER and the USER at the time the latter checks the corresponding box during the online sign-up process.
The contractual relationship involves the electronic granting of a right to use the parking lot in exchange for a specific fee that is publicly posted on the website.
Recruitment procedure
In order to access the products or services offered by the PROVIDER, the USER must register on the website by creating a user account. To this end, the USER must freely and voluntarily provide the personal data requested, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 (GDPR), concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Organic Law 3/2018 of December 5 (LOPDGDD), regarding the protection of personal data, as detailed in the Legal Notice and Privacy Policy of this website.
The USER will select a username and password, committing to make diligent use of them and not to make them available to third parties, as well as to notify the PROVIDER of the loss or theft of them or possible access by an unauthorized third party. , so that it proceeds to the immediate blockade. Likewise, through said registry, you can check the box for receiving advertisements for similar services, thereby distinguishing the different treatments that are made on them.

1. GENERAL CONTRACTING CLAUSES
Unless specifically stipulated in writing, placing an order with the PROVIDER will imply acceptance by the USER of these legal conditions contained in this text.
The general terms and conditions governing the purchase of the product or service will be those in effect at the time of purchase.
2. PURPOSE, DEFINITIONS AND SERVICES TO BE CONTRACTED.
These terms and conditions govern access to and the purchase of the products or services offered by Pavapark Movilidad, S.L. through its website (www.pavapark.com), as well as the use of such products or services by the individuals who purchase them. For these purposes, the following definitions shall apply:
- PROVIDER: The service provider will be Pavapark Movilidad, S.L., or, where applicable, the entity or commercial company providing the service.
- USER: The individual or legal entity that purchases the product or service through the website indicated above.
- PRICE: The price of the product or service will be the amount indicated for each product at the time of purchase.
- SUBSCRIBER: The natural or legal person who contracts a subscription product in any of its forms.
- SUBSCRIPTION: Subscription to the purchased product will result in automatic renewal of the product for a term identical to the one originally purchased.
The products and services available to the USER on the Pavapark e-commerce platform, for purchase at any of the affiliated parking facilities, are as follows:
- Advance Reservation/Day Pass: USERS who purchase this product may reserve a parking space for their vehicle in advance. USERS may cancel their purchase of this product up until the start of the contracted period.
- Parking Passes: The type of parking pass purchased will vary depending on the length of your stay in the parking lot. We offer 24-hour passes, daytime passes, nighttime passes, morning passes, afternoon passes, flexible passes, storage unit rentals, etc. The USER may review the features, duration, and hours of operation for each pass type at the parking facility where they wish to purchase the pass or on the pavapark website. The pass becomes valid upon purchase.
The hire date will apply only to the first payment; there are two options:
- Option 1: Subscription between the 1st and the 19th of the month: At the time of subscription, the USER will make an initial payment equal to the proportional amount of the subscription price for the remaining days of the month in which the subscription is purchased. On the 1st of the month following the subscription start date, the subscription will be automatically renewed for the full amount of the subscribed plan, and so on, on the 1st of each subsequent month.
For example: A USER is interested in signing up for a 24-hour monthly subscription for June and subsequent months, with a total cost of €120 (VAT included).
The USER enters into the contract on June 11. In this case, the USER will make a payment of €80 through the website, calculated by dividing €120 by the 30 days in June and multiplying by the 20 days during which the USER will be able to use the subscribed service.
On July 1, the amount of €120 for the next monthly payment will be automatically charged to the same payment method entered by the USER, and so on.
- Option 2: Signing up from the 20th through the last day of the month: At the time of subscription, the USER will make an initial payment equal to a proportional amount of the subscription price for the remaining days of the month in which the subscription is purchased, plus the full amount of the subscription, as an advance payment for the following month. The next payment will be due on the 1st of the second month following the subscription date, for the full amount of the subscription.
For example: A USER is interested in signing up for a 24-hour monthly subscription for June and subsequent months, with a total cost of €120 (VAT included).
The USER enters into the contract on June 26. In this case, the USER will make a payment of €140 through the website, calculated by dividing €120 by the 30 days in June and multiplying by the 5 days during which the USER will be able to use the subscribed service. This amount is increased by the €120 for the month of July, which the USER pays in advance.
On August 1, the amount of €120 for the next monthly payment will be automatically charged to the same payment method entered by the USER, and so on.
As explained, the plans you sign up for operate on a subscription basis that will automatically renew on the first day of each month.
As an exception, the telework allowance is exempt from this general rule and operates as follows:
- Subscriptions signed up between the 1st and 15th of the month: The USER will pay 100% of the amount for the telework subscription and will be entitled to use 100% of the days included in the subscription. On the 1st of the month following the subscription, the subscription will be automatically renewed for the full amount of the subscribed plan, and so on, on the 1st of each subsequent month.
- Subscriptions from the 16th through the last day of the month: The USER will pay 50% of the first month’s fee and 100% of the second month’s fee. Similarly, the USER will be entitled to use 50% of the contracted days in the first month and 100% of the contracted days in the second month. The next payment will be due on the 1st of the second month following the start of the contract, for the full amount of the contracted subscription.
Some of these products may be restricted to certain types of vehicles depending on the characteristics of the parking lot.
3. ACTIVATION OF SERVICES
The SERVICE PROVIDER will not reserve the contracted product or service until it has verified that the USER has made the payment.
As the order does not entail the physical delivery of any product, being the services contracted directly from the website, the PROVIDER will inform the USER in advance regarding the procedure to be followed to carry out this contract.
Lack of performance of the distance contract
The service will be available as soon as the USER has made payment and received the payment receipt, and may be downloaded or activated in accordance with the PROVIDER’s conditions and the terms of the contract.
The PROVIDER shall not be liable if the product or service cannot be downloaded or activated because the information provided by the USER is false, inaccurate, or incomplete.
The right to use the product or service shall be deemed to have been fulfilled at the time the USER makes payment for the service, regardless of whether or not the USER actually uses it.
4. RIGHT OF WITHDRAWAL
For reservations requiring advance payment, the customer will have a maximum of 14 calendar days to cancel the purchase, provided that the date and time of entry into the parking lot have not yet passed and the customer has not yet used the service. We will process the refund using the same payment method used by the USER.
In all other cases, the consumer shall be deemed covered by the exceptions to the right of withdrawal set forth in Article 103 of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
5. CLAIMS
Any claim that the USER considers appropriate will be attended to as soon as possible, and can be made at the following contact addresses:

6. FORCE MAJEURE
The parties will not incur liability for any fault due to a major cause. The fulfillment of the obligation will be delayed until the cause that caused the force majeure ceases.
7. COMPETENCE
The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.
If any stipulation of these conditions is considered null or impossible to fulfill, the validity, legality and fulfillment of the rest will not be affected in any way, nor will they be modified in any way.
The USER declares to have read, know and accept these Conditions in their entirety.
8. GENERALITIES OF THE OFFER
All sales and deliveries made by the PROVIDER will be understood to be subject to these Conditions in accordance with the version in force at the time of contracting.
Given the continuous technical advances and improvements of the services, the PROVIDER reserves the right to modify its specifications regarding the information provided in its advertising, as long as it does not affect the characteristics and value of the contracted services.
No modification, alteration or agreement contrary to the contracting conditions will take effect, except for an express written agreement signed by the PROVIDER, in this case, these particular agreements will prevail.
9. PRICE AND VALIDITY PERIOD OF THE OFFER
The prices listed for each product or service include Value-Added Tax (VAT) or any other applicable taxes.
The prices applicable to each product or service are those published on the website and will be expressed in euros. The USER acknowledges that the price of some services may vary in real time.
Before completing your purchase, you can review all the details of your quote online as your order is being finalized in the shopping cart: items, quantities, price, availability, fees, discounts, taxes, and the total purchase amount. Prices are subject to change daily until the order is placed.
Once the order is placed, the prices will be maintained whether the service is available or not.
In the event that the USER requires the issuance of an invoice, they must request it by completing the sections collected for this purpose in the contracting form. This invoice will be sent to the e-mail indicated in the corresponding section.

10. OBLIGATIONS OF THE PARTIES.
The USER will immediately communicate to the PROVIDER all incidents, errors and / or malfunctions detected throughout the provision of the service.
The USER will act in the car park with due diligence, respecting in all circumstances the rules and conditions of use of the space of each one of them, in accordance with good sectorial practices and its own regulations.
The USER agrees to pay in full all amounts charged to their credit card in connection with the products or services purchased. Any interest charges or penalties imposed by the financial institution associated with the credit card used by the USER shall be the responsibility of the USER, who must, if applicable, pay such amounts to the provider.
Both parties undertake to act in good faith and in accordance with the usual good practices of the sector.
11. FORMS OF PAYMENT, CHARGES AND DISCOUNTS
The USER will pay for the services purchased using the payment methods available on the website at the time of purchase.
The PROVIDER is responsible for the transactions carried out through the website www.pavapark.com
12. SAFETY
The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access to data. To achieve these purposes, the USER agrees that the provider may obtain data for the purpose of the corresponding authentication of the access controls.

The PROVIDER guarantees that every transaction made is 100% secure. All purchases you make on our website are secured by Banco Santander’s secure server, so your data is protected and encrypted using the most advanced technology. What happens when I send my data over the network?

All of your personal data and the information you provide to us is transmitted over the network in encrypted form, and is protected and encrypted before being sent for processing.
For payments with Visa and Mastercard, only CES (Secure Electronic Commerce) transactions will be accepted. The following activities are prohibited under the programs of the card entities: the sale or offer of a service that does not comply with all the laws applicable to the Purchaser, Issuing Bank, Merchant or Holder of the card or cards.
13. PURCHASE PROCESS
Cart (budget simulation)
Any service from our catalog can be added to the cart. In this, only the articles, the quantity, the price and the total amount will be observed. Once the cart is confirmed, the cart will proceed to contract the service with taxes, charges and discounts according to the payment and shipping information entered.

Upon signing up, an email will be sent to the USER confirming the order status and the sign-up date.
14. SUBSCRIPTION
As defined in these terms and conditions, during the purchase process, for certain products, a recurring monthly subscription for the purchased product will be automatically activated in accordance with the terms initially agreed upon, and payment will be processed through the payment method selected by the USER during the purchase process.
Unsubscription can be done through the following steps:

- Click on the Subscriptions section
- Click the View button for the subscription you want to cancel, or click the subscription number.
- Click Cancel in the Actions section.
- Once your subscription has been successfully canceled, you’ll receive a message saying “Your subscription has been canceled.” You’ll also receive an email informing you that your subscription has been canceled, along with details about your subscription.
Deactivating your subscription will affect your renewal, but the service you have in effect at the time of deactivation will remain active until it ends.
The application of discounts or promotions applicable at the time of contracting will not be deemed applicable to subsequent renewals in the case of a subscription; instead, the terms and conditions governing the discounts or promotions applied must be observed.
15. APPLICABLE WARRANTIES
The guarantee of the services offered will respond to the regulation contained in the articles of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other laws complementary.
16. GOVERNING LAW AND JURISDICTION
These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The PROVIDER and the USER agree to submit to the courts and tribunals of the USER’s domicile any controversy that may arise from the provision of the services subject to these Conditions.
In the event that the USER is domiciled outside of Spain, the PROVIDER and the USER expressly waive any other forum, submitting to the Courts and Tribunals of the city of Valencia (Spain).
